It’s a valid option if you want some protection for your name but you’re not quite ready to invest in a federal trademark.

It’s still recommended to check with a lawyer about your trademarking efforts even with a state trademark. They’ll be able to give you personalized advice for your name so it fits your long-term goals.

Reserve your company name

If you’re not quite ready to start your LLC or corporation but you’ve picked the perfect name, then reserving it is a great way to buy yourself some time. If you file a name reservation application, your state will essentially put a temporary hold on your name. They won’t allow another business to register under that name while the reservation is active. This gives you extra time to file your Articles of Organization or Articles of Incorporation, which will formally claim the name for your business. 

Every state has slightly different reservation procedures, but typically, you’ll file a form like the “Application for Reservation of LLC/Corporation Name” and pay a filing fee. A large number of states give you a 120-day reservation in return, but this varies. Please consult with your state’s website for specifics for your location.

One quick note: a name reservation is only valid in the state where it’s filed. For example, if you reserve a name in Indiana, it’s only protected in the Hoosier State. There would be nothing stopping a business in Ohio or Michigan from using the name unless you also filed (and formally claimed) a reservation in those states, too.
